1. Who we are

Poka is run by Bartłomiej Tokarzewski, a sole proprietor in Poland ("we"): ul. Rudzka 5D lok. 85, 01-689 Warszawa, Polska. NIP 1182213149, REGON 386974941. Contact: contact@modeltok.com.

These terms cover the Poka web app (https://poka.sh), the desktop apps, accounts and paid formats (the "Service"). By using the Service you agree to them. If you use Poka for an organisation, you confirm you may bind it. If you are a consumer, these terms do not take away rights that the law gives you.

2. What Poka does

Poka previews files. In the web app this happens in your browser. In the desktop app it happens on your device. Your files never leave your device, so we do not receive them (see the Privacy Policy). You keep all rights in your files.

A preview is Poka's reading of your file. It can be wrong or incomplete. For important decisions, check the original file in the software that made it.

Poka is in beta phase, parts may be changed.

3. Free and paid formats

The app and a set of basic formats are free, for everyone, including businesses. We give you a non-exclusive, non-transferable licence to use them.

Other formats are paid. You get a paid format in one of two ways:

• Buy it once. You pay once and may use that format, and its later versions, with your account for as long as we provide it.
• Subscribe. One subscription covers every paid format while it is active. You can pay monthly or yearly.

There are no bundles and no levels. You can use your account on up to 3 devices. A subscription does not renew by itself: you pay for each month or year you want. When the period you paid for ends, access to formats that only the subscription covers ends too. Formats you bought once stay yours.

A format you bought once stays yours if you also subscribe, and we should not charge you twice for a format you already have.

4. Your account

You need an account only for paid formats. You sign in with a link we email you, and may add an authenticator for extra protection. Keep your mailbox and authenticator secure: you are responsible for what happens under your account. Tell us at once if you think it has been misused. You must be at least 18 to create an account or buy.

You can be signed in on up to 3 devices at once. If you sign in on a 4th, we sign out the oldest session, and that device must sign in again. This applies to every account, free or paid.

You can ask us to close your account at any time: email contact@modeltok.com.

5. Prices and payment

The price is shown before you pay, in euros (EUR), VAT included. Stripe takes payment on its own page; we never see your card details. Your bank may charge for currency conversion. We may correct an obvious pricing mistake before we accept your order.

6. Your right to cancel

Your rights to cancel and to a refund are in the Refund Policy, which is part of these terms. Nothing here limits your legal right to withdraw from a purchase as a consumer.

7. What you must not do

• Copy, resell, share or publish a paid format, or your access to it.
• Reverse engineer Poka, or get round the checks that tie a paid format to an account, unless the law allows it.
• Use Poka to break the law, attack others or overload the Service.

Poka includes open-source and third-party parts under their own licences, listed in THIRD-PARTY-NOTICES.txt in the apps. Some media features use programs on your computer, such as ffmpeg and libmpv, which are not part of Poka and may be missing.

Poka, its names and logos belong to us or our licensors. If you send us feedback, we may use it free of charge.

8. Changes and ending

We may update paid formats and the Service. If we stop providing a paid format, or remove a main feature of it, we will email you at least 30 days before and refund the unused part of what you paid. We will also give you 30 days' notice before we end the Service.

You may stop using Poka at any time. We may suspend your account or access to paid formats if you seriously break these terms, for example by sharing a paid format or committing payment fraud. If we end your access without a breach by you, we refund the unused part of what you paid.

We may change these terms. We will post the new version with a new date and email account holders at least 30 days before a change that makes their position worse. If you do not agree, you can stop using Poka and ask for a refund of any unused period. A change does not alter a format you have already bought.

9. Liability

Poka's free tier is provided "as is". Nothing in these terms limits liability that the law does not allow us to limit, including your statutory rights if digital content does not match what we promised. Otherwise, as far as the law allows, we are not liable for indirect loss, lost profits or lost data, or for loss from relying on a preview.

10. Law and disputes

Polish law applies. If you are a consumer, you keep the protections of the country where you live and may sue in its courts. For business customers, the court competent for our seat decides. Please contact contact@modeltok.com first so that we can try to fix the problem.

11. Support and general

We aim to reply to messages within 14 days. These terms, the Refund Policy and the Privacy Policy are the whole agreement between you and us. If a part is invalid, the rest stays. We may email you at your account address.
